If the mortgage company had not properly credited or applied the consumer’s payments, or refused to abide by an agreement it had made with a homeowner to avoid foreclosure, Bob would advise the client how a Chapter 13 bankruptcy works, and that these “other issues” would be resolved in the Chapter 13 case.

While the remedies provided by the Bankruptcy Code are powerful and advantageous for consumers and individuals in financial distress, Bob knows that Bankruptcy is not always the best option for some consumers.

This greed and sloppiness can result in actions which are improper and illegal, and come at the expense of the people who these companies need the most: their customers.
